Occupational Health and Safety Act, 85 OF 1993

The Act consists of 50 sections as approved by parliament.

The aim of the OHS Act is to provide for the safety and health of persons at work and in connection with the use of plants and machinery. It further provides for the protection of people other than people at work from hazards arising out of or in connection with the activities of people at work.

The main objective of the Act could be described as a proactive attempt to prevent and avoid work-related injuries and illness. The Act governs the health, safety and environment of the diverse industry of South Africa. It regulates and controls health and safety in all organisations, from a normal office environment to more hazardous environments like industrial plants and construction sites.

The generic structure of the legislation is used to access information on three different aspects.

It provides the primary framework within which the Contractor is required to demonstrate compliance with certain requirements for occupational health and safety:

  • Established by the Occupational Health and Safety Act of 1993;
  • Establishes the manner in which the Contractor is to manage the risk of health and safety incidents in the execution of the contract; and
  • Establishes the manner in which the Employer’s health and safety agent will interact with the contractor.
