In the event of being the investigator:
- Conduct the investigation
- Gather all the evidence
- Obtain statements from the witnesses
- Determine the elements of the misconduct
After investigations have been completed, the complainant must:
- Draft and finalise the complaint(s) and obtain second opinion, if need be.
- Complete the notice accurately and ensure details are correct. This is of the outmost importance.
- Inform the employee and issue notice in time to allow opportunity that employee may find a representative and to prepare.
- Hand a copy of the notice to the chairperson without discussing the case or evidence.
- Inform the witnesses of the date, prepare the witnesses thoroughly, inform them what to expect, and explain the procedures.
- Have a copy of the company ‘disciplinary code and procedures’ available to use and refer to during the hearing.
